世界自由贸易港运行规则对我国的启示

　　[摘要]我国自由贸易港建设应借鉴已有的成功经验，并且顺应世界自由港目前面临的国际局势和发展趋势。应制定自由贸易港发展的法律新框架，从国家层面制定专门的自由贸易港法律，并完善相關的配套法律法规，各相关部门也需制定配套的规章和规范性法律文件，以保证自由港的正常有效运行；设立权力集中的高效管理机构，从中央到设有自由港的地方建立专门的自由贸易港管理委员会，各相关部门在自由港内集中办公，形成高效的管理体制；探索实施国际通行的贸易、投资、金融、税收等制度，并逐步完善其他相关配套政策；完善风险防控体系和监管制度，政策上采取循序渐进的方式，优惠力度从小到大，采取审慎的风险控制措施，依托信息化监管手段，建立自由灵活的监管机制；借助“一带一路”倡议构建港口联盟，与此同时，不断完善我国自由港自身的运行规则。

　　Abstract： The construction of Chinas free port should draw lessons from the existing successful experience， and conform to the current international situation and development trend of the free port in the world. A new legal framework for the development of free port should be developed， and to formulate special free port laws at the national level and improve relevant supporting laws and regulations， and relevant departments should also formulate relevant regulations and other normative legal documents to ensure the normal and effective operation of free port； set up efficient management organization with centralized power， and special free port management committees should be established from the central government to places with free ports， and all relevant departments should concentrate their work in free ports and form an efficient management system； explore and implement internationally accepted trade， investment， finance and taxation systems， and gradually improve other relevant supporting policies； improve the risk prevention and control system and the regulatory system， take a step-by-step approach on the policy， the incentives range from small to large， take prudent risk control measures， and to establish a free and flexible supervision mechanism rely on the means of information supervision； build a port alliance with the Belt and Road initiative， and improve the operation rules of our free ports at the same time.

　　自由贸易港简称自由港（Free Port），作为促进本国或地区经济及国际经济贸易发展的自由经济区域，拥有其特殊的国际地位。1547年，意大利宣布在西北部热那亚湾建立雷格亨（Leghoyh）自由港，资料显示这是世界上第一个被正式命名的自由港，[1]距今已有470年的发展历史。比较典型的自由贸易港有中国香港、新加坡、鹿特丹、迪拜、亚丁、贝鲁特、汉堡、巴拿马等自由港。
　　“十九大”报告提出，赋予自由贸易试验区更大改革自主权，探索建设自由贸易港。在这样的背景下，比较研究各自由贸易港的监管模式具有一定的现实意义，以期对我国自由贸易港建设提供借鉴。
　　一、自由贸易港的概念
　　关于自由港的概念，不同的学者存在不同的理解，也有与自由港性质相近但称谓不同的术语，目前并未形成权威的定义。例如，根据郭信昌的研究，自由港（Free Port）又称自由口岸，指全部或绝大多数外国商品可以豁免关税进出的港口。[1]汪洋在《推动形成全面开放新格局》一文中提出，自由港是设在一国（地区）境内关外、货物资金人员进出自由、绝大多数商品免征关税的特定区域，是目前全球开放水平最高的特殊经济功能区。[2]随着国际贸易和国际物流的发展，自由港已不仅仅依赖于海港设立，出现诸如爱尔兰的香农和荷兰的斯希普霍尔等世界著名的自由航空港，还有如苏黎世这样的陆港，未来也不排除出现太空港的可能，而且世界上成功的自由港已呈现出海陆空复合发展的趋势。另外，自由港在其建立和发展的过程中，个体之间也会出现不同的情况及特点。综上所述，笔者认为自由港是一个动态的概念，随着社会的发展，其特征及功能定位等也会相应地发生改变。从第一次提出自由港这个概念以来，各国或地区根据自己的发展实践，分别制定了适应自己的特殊经济区域政策，并对此进行了多方位的研究，同时也积累了一定的经验。
